FDA, Wite House Disagree Over Drug Liability Rules

A new report released on Wednesday by the House Oversight and Government Reform Committee finds that the FDA is at fault for their handling of rules that were put in place to handle drug liability.

According to court papers, the FDA and White House staff, clearly disagreed on a number of things regarding liability in areas of protecting drug companies from being sued.

According to the documents, more often than not, top administration officials in the Bush government, were of the belief that warning labels on drugs to warn of dangerous side effects, were adequate and always up to date.

The FDA was of the position that new information sometimes comes to the surface pertaining to drugs, and that when this happens, people, mainly doctors and patients need to be notified.

They state that the government’s current policy when it comes to drug makers is more based towards making it harder for consumers to sue drug makers based on side effects that are not part of the warning label of drugs.

“Much of the argument for why we are proposing to invoke pre-emption seems to be based on a false assumption that the FDA approved labeling is fully accurate and up-to-date in a real time basis,” stated a report.
